1. Acceptance of Terms

Welcome to AI Travel Concierge ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application and website (collectively, the "Service"), which provides AI-assisted travel itinerary planning, trip sharing, and related features.

By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate and complete information when registering and to keep it current.
• You must notify us promptly of any unauthorized use of your account.
• We may suspend or terminate accounts that we believe violate these Terms.

4. Subscriptions & Billing

AI Travel Concierge offers a free tier and a paid Premium subscription. Subscriptions are digital-only and are billed through our platform payment provider.

• Free tier: Access to basic journey planning with limited features.
• Premium tier: Unlimited journeys, full itinerary editing, packing lists, budget tracking, trip sharing, and priority AI assistance.
• Pricing is displayed within the app at the time of purchase. Subscription fees are billed in advance on a recurring basis depending on the plan you select.
• You may cancel your subscription at any time from the Account page. Cancellation stops future billing; access continues until the end of the current paid period.
• Except where required by law, subscription fees are non-refundable.

5. AI-Generated Content

The Service uses large language model (LLM) AI services — including OpenAI and Google (Gemini) — to generate itineraries, recommendations, and assistant responses. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or outdated, and should not be relied upon as the sole source for travel, safety, or financial decisions.
• You are responsible for verifying all recommendations, bookings, schedules, pricing, and travel requirements before acting on them.
• We do not guarantee the availability, accuracy, or quality of any third-party booking service, flight, hotel, or activity referenced in AI output.
• Your use of AI features is subject to the data practices described in our Privacy Policy.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Upload, share, or store content that is unlawful, infringing, harassing, defamatory, or otherwise objectionable.
• Attempt to access, disrupt, or reverse-engineer the Service, its systems, or its integrations.
• Use automated tools to scrape, query, or overload the Service.
• Impersonate another person or misrepresent your affiliation with a person or entity.
• Use AI features to generate content that violates these Terms or any provider usage policies.

7. User Content & License

You retain ownership of the trip details, preferences, and other content you submit to the Service ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, process, and display your User Content solely as needed to provide and improve the Service, including transmitting it to our AI providers to generate your itineraries. When you share a journey, your shared itinerary content is visible to the collaborators you invite according to the permissions you set.

8. Third-Party Services

The Service references and may link to third-party booking platforms, airlines, hotels, activity providers, and mapping services. We are not responsible for the availability, accuracy, pricing, or conduct of these third parties. Your interactions with third-party services are governed by their own terms and policies.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any itinerary or recommendation will meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by law, in no event shall AI Travel Concierge, its affiliates, or its providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty U.S. dollars (USD $50) if you have not made any purchase.

11. Indemnification

You agree to indemnify and hold harmless AI Travel Concierge and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms.

12. Intellectual Property

The Service, including its design, features, and branding, is owned by AI Travel Concierge and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, trade names, or logos except as expressly permitted in writing.

13. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases, and these Terms will no longer govern, except that sections which by their nature should survive (including disclaimers, limitation of liability, and indemnification) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" above or by other reasonable notice. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. You and we agree to attempt to resolve disputes informally before initiating formal proceedings.
